These Terms of Use ("Terms") govern your use of reboundfinance.com and its subdomains (the "Site"), operated by 6069321 Canada Inc., doing business as Rebound Finance ("we," "us," or "our"). By accessing the Site or submitting your information, you agree to these Terms and to our Privacy Policy and SMS / Messaging Terms, which are incorporated by reference. If you do not agree, do not use the Site.

1. Eligibility

The Site is intended for U.S. residents who are at least 18 years old (or the age of majority in their state) and have the legal capacity to enter into a contract. By using the Site, you represent that you meet these requirements.

3. How the Service Works and How We Are Compensated

When you submit your information, we use it to match you with lenders, lending partners, and marketing partners. We do not work with every lender or product, so the offers you see are not a complete market comparison. We are compensated by lenders and marketing partners when we refer or match consumers, and that compensation may affect whether, and in what order, offers are presented to you.

4. Your Representations

You represent and warrant that the information you submit is accurate, current, and complete; that you are the person whose information is submitted (or are authorized to submit it); and that you own or are authorized to use the telephone number and email address you provide. You agree not to submit another person's information without authorization.

5. Consent to Be Contacted (TCPA)

By submitting your information and providing your consent, you agree that Rebound Finance and its lenders, lending partners, and marketing partners may contact you at the telephone number and email address you provide, for marketing and servicing purposes, using automatic telephone dialing systems, prerecorded or artificial-voice (including AI-generated voice) messages, ringless voicemail, text messages (SMS/MMS), and email — even if your number is listed on a federal or state Do Not Call registry.

Your consent is not a condition of purchasing any goods or services or of using our service. Message and data rates may apply, and message frequency varies. You may revoke your consent at any time by any reasonable method (including replying STOP to a text, using an email unsubscribe link, or contacting us), and we will honor your revocation within 10 business days. 6. Consent to Electronic Communications (E-SIGN)

You consent to transact business with us electronically and to receive disclosures, notices, agreements, and other communications electronically under the federal E-SIGN Act. To access and retain electronic records, you need a device with internet access, a current web browser, and an email account. You may withdraw this consent or request paper copies by contacting us at legal@reboundfinance.com; withdrawing consent may prevent you from using the Site.

7. Authorization to Share Information and Credit Consent (FCRA)

By submitting your information, you authorize Rebound Finance to sell and share it with lenders, lending partners, and marketing partners as described in our Privacy Policy. You further authorize those lenders and partners to verify your information and, under the federal Fair Credit Reporting Act (FCRA), to obtain your credit report and credit score from consumer reporting agencies (such as Experian, Equifax, and TransUnion) and from alternative data sources, in order to evaluate your request and verify your identity. A "soft" inquiry generally does not affect your credit score; a "hard" inquiry may. You acknowledge that if you accept a loan, non-payment may be reported to the credit bureaus.

8. License and Acceptable Use

We grant you a limited, revocable, non-exclusive license to use the Site for your personal, non-commercial purposes. You agree not to scrape or harvest data, submit false or fraudulent information, interfere with or disrupt the Site, or use the Site for any unlawful purpose.

9. Intellectual Property

The Site and its content, trademarks, and materials are owned by us or our licensors and are protected by law. You may not copy, reproduce, or use them without our prior written permission.

10. Third-Party Lenders, Partners, and Links

We are not responsible for the products, terms, decisions, conduct, or websites of lenders and partners, and we do not endorse them. Any loan or agreement is solely between you and the lender or partner, and any dispute regarding it must be resolved with them. Review each lender's and partner's own terms and privacy policy before proceeding.

11. Disclaimer of Warranties

The Site and our services are provided "as is," "as available," and "with all faults." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.

12. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, and our total liability arising out of or relating to the Site or these Terms will not exceed $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Rebound Finance, its affiliates, and its partners from any claims, losses, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, the information you submit, or your misuse of the Site.

14. Binding Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights.

Except as provided below, any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and not in court. Any in-person arbitration hearing will take place in the county (or federal district) where you reside, or by telephone or video, unless you and we agree otherwise. You and we waive the right to a jury trial and the right to participate in a class, consolidated, or representative action or class arbitration.

Public injunctive relief carve-out. Nothing in this section waives your right to seek public injunctive relief to the extent that right cannot be waived under applicable law (including for California residents under McGill v. Citibank); any such claim will proceed in court after any other claims are arbitrated. Either party may also bring an individual claim in small-claims court or seek injunctive or other relief for intellectual-property matters in court.

Right to opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice with your name and the phone/email you used, to 6069321 Canada Inc., Attn: Legal, 4000 Notre-Dame Ouest, Montreal, QC, Canada H4C 1R1, or by email to legal@reboundfinance.com. Opting out will not affect any other part of these Terms.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except that (a) the Federal Arbitration Act governs the arbitration provision above, and (b) nothing in this section overrides the mandatory consumer-protection laws of your state of residence, which continue to apply to you. For any dispute that is not subject to arbitration, the exclusive venue is the state and federal courts located in New Castle County, Delaware, and you and we consent to personal jurisdiction there; in-person arbitration hearings are held in your home locale as described in the arbitration section above.

16. Termination

We may suspend or terminate your access to the Site at any time. The sections regarding consent, credit authorization, intellectual property, disclaimers, limitation of liability, indemnification, and arbitration survive termination.

17. Changes to These Terms

We may update these Terms from time to time by posting the updated version with a new "Last Updated" date. Your continued use of the Site after an update constitutes acceptance where permitted by law.
